Since Canada’s Criminal Code was amended in 2004 allowing for corporations and senior officers to be held criminally liable for harm caused at work, few have faced the risk of prosecution. Meantime, unsafe and unhealthy work continues to kill thousands of Canadians each year.
Workers, their representatives, regulators, victims, politicians, employers, practitioners and academics will gather on October 24 and 25 in Ottawa to discuss and debate why criminal laws regarding workplace safety are rarely enforced. They will also explore the growing international interest in corporate criminal liability.

This symposium marks the 20th anniversary of the Westray mine disaster where 26 miners lost their lives in a Nova Scotia mine explosion. A public inquiry into the disaster resulted in recommendations to amend the Criminal Code to allow for charges against corporations, their officers and those who direct work when workers are killed or suffer bodily harm. A campaign led by the United Steelworkers Union, other labour groups and the Westray Family Group then helped to secure the Criminal Code reforms, commonly referred to as Bill C-45 or the Westray Bill.
Labour and others continue to call for tougher application of the law.
